These are the Terms of Service for tellsophie.com. By using the website, you agree to them. The iOS application, when it launches, will have a separate, fuller set of terms that supersede these for use of the application.

What the website is

tellsophie.com is a pre-launch marketing website for an iOS application that we are building. The application is not yet available. The website lets you read about the product and join a list to be notified when the application launches.

What the signup list is

If you sign up and confirm your email, we will send you exactly one email when the iOS application launches. If you also opt in to occasional updates, we may send you a small number of additional emails. You can unsubscribe from any email with a single click.

The "Get notified when we launch" call to action is not a contract. It is a description of what we plan to do.

Pre-launch product descriptions are intent, not commitment

The website describes features, pricing, policies, and commitments for the iOS application that has not yet launched. These descriptions reflect what we currently intend to ship. The product as built may differ. The trust commitments on the Trust page and the Loss Policy describe principles we are designing the product around. The contractual versions of those commitments will be in the Terms of Service for the iOS application when it launches.

If you sign up and the product as launched is meaningfully different from what we described, you can simply not download it and unsubscribe from the list.

Acceptable use

When you use the website you agree:

• Not to scrape it with automated tools beyond what robots.txt permits.
• Not to attempt to access data that isn't yours.
• Not to submit signups for email addresses you don't control.
• Not to attempt to overwhelm or disrupt the service.
• Not to misrepresent yourself in any communication with us.
• Not to upload malware, executables, or malicious payloads through any form on the site.
• Not to use the site for any unlawful purpose, or in violation of any applicable law or regulation.

Intellectual property

The content on tellsophie.com (text, design, code, illustrations) is ours or licensed to us. The wordmark, the brand name, and the visual identity are ours. You may share links to the website. You may quote short passages with attribution. You may not copy the design or republish substantial passages without permission.

The email address you submit is yours.

Disclaimers

The website is provided as-is. We do not warrant that it will be uninterrupted, error-free, or secure beyond commercially reasonable measures. We do not warrant that the iOS application will launch on any particular schedule, in any particular form, or at all.

If we decide not to launch the iOS application, we will email everyone on the list and offer to remove their email from our records.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any damages arising from your use of the website beyond the amount you paid us, which for the marketing website is zero. This limitation does not apply to liability that cannot be excluded by law, including liability for gross negligence, willful misconduct, or fraud.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles.

Disputes

Changes to these Terms

If we change these Terms in a way that materially affects you, we'll email you at the address on file before the change takes effect, if you've signed up. For everything else, we'll update the "Last updated" date at the top.

If you do not agree to a change, your remedy is to stop using the website and to unsubscribe from any list you've joined.

Severability

If a court finds any part of these Terms unenforceable, the rest still applies.

Entire agreement

These Terms, together with the Privacy Policy and any other documents linked from this page, are the entire agreement between you and us regarding your use of the website.
